ALBANY, N.Y. -- Construction workers protested the state's freeze on funding for construction projects. About 50 workers holding signs and wearing their work gear converged on the Capitol.

"Everybody's worried day by day if they're going to have a job tomorrow," said Jeff Kenyon, superintendent for the Northway Exit 6 project.

With no state budget in sight, industry leaders said thousands of construction workers and hundreds of projects are being affected. No budget means no money and so several groups have filed suit.

"These are projects that were bid out publicly, were awarded to the contractors and now the state has stopped paying them in the middle of a contract. It's a breach," said Ross Pepe, president of the Construction Industry Council.

The rally ended at the State Supreme Court where attorneys for the construction industry argued in front of a judge against the state's actions.

"These guys have families and mortgages and bills due, and it's kind of scary when you're told you're not gonna get paid," said Kenyon.

He considers himself lucky. His Exit 6 project is still going because the contractor is paying out of pocket. Still, a show of hands revealed just how many workers at the rally are not working.

"I have a little girl, and I'm a little nervous," said construction worker Heather Landacre.

"In this economy, where are you going to find a job?" asked another construction worker, who said many of his friends have already started looking.

There's no word yet on when there will be a decision on the lawsuit.
