Judges considering change of venue request as jury selection continues

ALBANY, N.Y. -- Jury selection continued Friday in the trial of Devon Callicutt, the man accused of fatally shooting UAlbany student Richard Bailey in 2008.

The State Supreme Appellate Court deputy clerk tells YNN that five judges will consider Callicutt's application for a change of venue that was submitted by his attorney on Thursday.

Dec. 13 is the day the court is scheduled to issue a ruling, but the court could have a decision as early as next week.

Callicutt's attorney did not make an official motion for a stay in the proceedings, so jury selection continues as scheduled.

The 20-year-old is accused of shooting Bailey during an attempted robbery in October 2008. King Modest, 18, and Ricardo Caldwell, 19, have pleaded guilty to attempted first-degree robbery and are expected to testify against Callicutt at trial.

Judge issues gag order


Day two of jury selection wrapped up Thursday in the trial of Devon Callicutt who is accused of fatally shooting UAlbany student Richard Bailey in 2008 during an attempted robbery. The judge issued a gag order for all parties in the case for the remainder of jury selection. This comes as the defense says they filed a motion for a change of venue.
