COLONIE, N.Y. -- A man is under arrest and in the hospital after a shootout with Colonie police. It happened on Leach Avenue just after 7 p.m. Wednesday.
Police say they got a tip that Agostino Jubrey, 20, was involved in a hit and run accident in Columbia County. Acting on that tip, police arrived at the home to find Jubrey fighting with his mother and stepfather. They say Jubrey shot his stepfather, then jumped into his car and tried to drive off. He backed into a police car and then began shooting at police.
Officers fired back, hitting Jubrey in the head.
No officers were injured.
"It's very early in the investigation, however, right now, we have no indication at all that the officer did anything wrong. It appears that he acted within his rights, defending himself and the mother and stepfather," said Lt. Robert Winn.
Jubrey was taken to Albany Med for surgery and we're told he was in stable condition when he arrived.
