SCHENECTADY, N.Y. -- The scene in Schenectady remained active well after the shooting. Police arrested Rivera's sister after she was shouting at police.

They say Iris Vasquez, 24, became belligerent with officers while trying to create a memorial for her brother at the crime scene.

Vasquez is charged with obstructing governmental administration and disorderly conduct. She told us her brother Luis was trying to sell the gun that she says wasn't loaded...

"He is not a bad person. He does not get into no problems with nobody. He helps people with his groceries. He was raised by good people from Puerto Rico and he don't cause trouble,” said Vasquez, victim’s sister.

Police are working on a full investigation into exactly what happened, but again, officials say initial reports indicate officers were acting within the law.
