LATHAM, N.Y. -- A Colonie man is dead after an accident Wednesday night on Old Niskayuna Road. Police say the driver lost control and struck a tree near Runway Avenue in Latham.

His passenger, Jeffrey Bogardus, 39, was brought to Albany Med and pronounced dead.

Police do not believe alcohol was a factor in the crash.
