TROY, N.Y. -- A second trial in the ballot fraud case against two Troy Democrats could end up straining county finances.

A judge declared a mistrial in the case against Edward McDonough and Michael LoPorto this week. Officials say, so far, the trial has cost the county more than $150,000.

The extra expense is due in part to the case being handled by a special prosecutor and not the district attorney, who is salaried.

Rensselaer County Executive Kathy Jimino said while she won't speculate on whether the men should be re-tried, officials still have to figure out how to finance the case.

"I'm disappointed that the first trial didn't resolve this issue, because now we are looking at additional expenses on the part of the special prosecutor, but right now our objective is to find out. Let's try to quantify that so that we can adjust our budget," said Jimino.

McDonough and LoPorto are accused of taking part in a plot to forge ballots to secure the Working Families Party line for Democrats in 2009.

Jimino said another trial could bring the total cost of the case to about $250,000.
