Man shot during struggle with Trooper
State Police continue their investigation after a fatal shooting in the Town of Newburgh Thursday night. State Police say it happened when a Trooper pulled a driver over on Route 32. Elaina Athans has more.

TOWN OF NEWBURGH, N.Y. -- A Newburgh man is dead after he was shot by a state trooper during a struggle on a traffic stop in the Town of Newburgh.
According to State Police, a Trooper David Ruderfer pulled over a Lexus on Route 32 shortly after 7:30 p.m. Thursday. During the stop, a physical altercation broke out on the shoulder of the roadway and the trooper shot William Baynes in the stomach.
Troop F Commander Major Ed Raso said, "A short time into the stop, a struggle ensued between the operator of the vehicle and the trooper. There was a physical altercation, a fight, and at some point one round was fired into the suspect. The suspect collapsed, was taken into custody, taken by ambulance to the hospital and expired at the hospital."
The trooper was treated for injuries sustained during the struggle.
The incident is under investigation.
