TROY, N.Y. -- The fate of Rensselaer County's Democratic Board of Elections Commissioner is in the hands of a jury.

Edward McDonough is accused of submitting forged ballots in the 2009 Working Families Party Primary.

Jurors will be back in the morning to deliberate on the case after having it handed to them shortly after noon on Monday.

Special Prosecutor Trey Smith presented exhibits of excuses written on absentee ballots he says were written by McDonough.

Smith also presented a handwriting expert to back up that claim.

"He didn’t give a fig about the right to vote despite having a call of duty to do just that, this is more arrogance and entitlement from the defendant," said special prosecutor Trey Smith.

"The rest of the case very little bit that you even have implicating Mr. McDonough of anything is so weak, it couldn't hold rice paper," defense attorney Brian Premo said.

This is McDonough’s second trial. A jury was unable to reach a verdict in his first trial back in March.
