ALBANY, N.Y. -- The state court of appeals reverses a decision involving the pension of former Schenectady schools facilities director Steven Raucci, who was convicted in 2010 on arson and intimidation charges. The case being sent back to the appellate division.
A lower court ruled that one of Raucci's victims could freeze his pension payments and hold them to settle lawsuits under the so-called "Son of Sam Law."
The court of appeals says the victims' attorneys argued incorrectly the "Son of Sam" Law trumps other parts of the New York Penal code, as opposed to Social Security Laws.
The case now returns to the Appellate Division, who will consider that argument.
