EAST GREENBUSH, N.Y. -- The son of the Rensselaer Police Chief facing a DWI charge for his involvement in a fatal crash in East Greenbush last week has been placed on leave pending paperwork from the labor attorney, according to department officials.

The accident happened on Third Avenue Extension and Grove Street just after 5 a.m. last Wednesday.

Police say the driver, Mark Fusco, 22, was driving drunk when his car hit a tree. Fusco's passenger, Sean Murphy, 22, of Slingerlands, was thrown from the car and died at the scene.

Department officials say the younger Fusco joined the department over the summer and the chief is not handling anything related to the crash.

East Greenbush police are heading the investigation.
