Troy police release details on man who died in custody

TROY, N.Y. -- Troy police have released partial results of an autopsy performed on an Albany man who died over the weekend while in police custody.

Herbert Flowers, 31, was pulled over Saturday for driving without a brake light. Police said Flowers initially refused to stop, but he eventually did and was placed under arrest. Police said he appeared to have a white powdered substance around his mouth when he was placed in the patrol car.

Shortly after, police said Flowers began to have what appeared to be a seizure. He was treated by the Troy Fire Department, then taken to Samaritan Hospital where he was pronounced dead.

The victim's family is now questioning the details of the incident, and Troy police are responding.

"The area was canvassed by detectives and an assistant chief called in immediately to oversee the investigation. And we refute any allegations that Mr. Flowers died at the hands of police or his injuries were caused by police. There were no injuries other than resuscitative measures taken at the scene," said Chief John Tedesco.

Toxicology results are pending, but during the autopsy medical personnel retrieved a broken plastic baggie consistent with the packaging of crack cocaine from his stomach. They also found what appeared to be crack cocaine itself in his stomach. The items have been sent out for testing.
