POESTENKILL, N.Y. -- State Police said a sergeant shot and killed a despondent man who aimed a rifle at him during a brief standoff late Tuesday night in Rensselaer County.
State Police received a call around 9:30 p.m. Tuesday from a woman out-of-state who said she had received a phone call from her brother who was armed with a gun and threatening to kill himself. She said her brother, Daniel Burgum, 54, had been despondent recently and had been drinking when he called her.
Troopers from Brunswick and Schodack as well as Rensselaer County sheriff's deputies responded to Burgum's home at 99 Dater Hill Road in the Town of Poestenkill where they secured a perimeter. Phone calls to Burgum's house and cell phone went unanswered, and crisis negotiators were called to the scene.
State Police said Burgum came out of the house around 11 p.m. and shouted, "I know you're out here." State Police said Burgum then turned a loaded .22 caliber rifle on a State Police sergeant who had told him to put down the gun. The sergeant fired his gun four times, hitting Burgum more than once. No other officers at the scene fired their weapons.
Troop G Commander Major William Sprague said, "The fact that Mr. Burgum was armed and threatened the use of this firearm against members present, met the criteria for the justified use of physical force."
Burgum was taken to Samaritan Hospital where he was pronounced dead. State Police said notes were found inside the home indicating Burgum wanted to die.
State Police aren't releasing the name of the sergeant who shot Burgum, but they said he is a veteran of the force. He is currently on leave, but for scheduling reasons, not because he's being disciplined.
